John Veschini of the VIP Party, requests information from the Municipality of the Witzenberg on 23rd August, 2011, regarding legal cases which the Municipality are involved with and that may have substantial financial implications for the Ratepayer of the Witzenberg.  </B></div> <bR> <div> <B>After the date of the writing of the letter below, yet a further case has been brought to the attention of the Councillor and that is a case against the Municipality for  about R15 million!</B></div> <bR> <div> <B>It has also become apparent that in at least one instance, the complainant is suing both the Municipal Manager and The Director of Financial Services and the Ratepayer is paying their costs of defending their respective actions?</B></div> <bR> <div> 23 August, 2011</div> <bR> <div> The Municipal Manager</div> <div> Witzenberg Municipality.</div> <bR> <div> Dear Municipal Manager,</div> <bR> <div> Legal matters which the Municipality is involved with in respect of the following;</div> <bR> <div> Gert Bezuitenhout </div> <div> Frank Daniels</div> <bR> <div> I would care to know under what delegation, these legal matters have been authorized and whether there is a Council resolution authorizing the expenditure. Was the delegation made to the Mayoral Executive Council, or was the delegation made to the Municipal Manager.</div> <bR> <div> I note that in one of the cases, the respondents are both the Municipal Manager (David Nasson) and the Witzenberg Municipality. I note that in another of the cases, the respondent is both the Director of Corporate Finances (Mr. R Esau) and the Witzenberg Municipality. I would care to know who is to be responsible for the legal fees of David Nasson and Mr. Esau and who authorized this expenditure and when was such expenditure approved by Council.</div> <bR> <div> I would be happy to receive a summary of all attorneys, advocates, etc. who have been engaged in these matters, what their average fees per hour are and what both these cases have cost the Municipality thus far in monetary terms up to the present and what is a fair estimate on how much Council could end up paying in total, to resolve both matters.</div> <bR> <div> Kind regards,</div> <bR> <div> Clr.
